These Terms of Use ("Terms") constitute a legally binding agreement between JALA Academy, its affiliates, subsidiaries, franchise partners, successors, and assigns ("JALA Academy", "we", "our", or "us") and any individual, student, learner, visitor, intern, candidate, recruiter, employer, organization, or entity ("User", "you", or "your") accessing or using our website, applications, learning platforms, training programs, internship programs, placement services, certifications, content, software, products, and services.

By accessing or using any JALA Academy service, you acknowledge that you have read, understood, and agreed to be bound by these Terms, our Privacy Policy, Refund Policy, Rules & Guidelines, and any program-specific requirements.

1. Eligibility

You must have legal capacity to enter into a binding agreement under applicable law.

If you are under the age of eighteen (18), access to our services may require parental or legal guardian consent where required by applicable law.

2. Services Offered

JALA Academy may provide educational services including but not limited to:

  • Online and offline training programs
  • Job guarantee programs
  • Internships and project-based learning
  • Certification programs
  • Career guidance and placement assistance
  • Employer engagement programs
  • Learning management systems and digital content
  • Recruitment and workforce development services

Services may be modified, expanded, restricted, suspended, or discontinued at our discretion.

3. User Accounts

Users are responsible for maintaining the confidentiality of account credentials and all activities occurring under their accounts.

You agree to provide accurate, current, and complete information and to update such information whenever necessary.

4. Acceptable Use Policy

Users shall not:

  • Violate any applicable law or regulation
  • Engage in fraudulent, deceptive, or misleading conduct
  • Upload malicious software or harmful code
  • Attempt unauthorized access to systems or data
  • Disrupt platform operations or services
  • Harass, threaten, abuse, or discriminate against others
  • Engage in plagiarism, cheating, or academic misconduct
  • Misrepresent qualifications, credentials, or experience
  • Use services for unlawful commercial purposes

5. Intellectual Property Rights

All course materials, software, source code, videos, presentations, documentation, assessments, trademarks, logos, designs, graphics, content, learning resources, and educational materials remain the exclusive property of JALA Academy or its licensors.

Except as expressly permitted, users may not copy, reproduce, distribute, modify, publish, reverse engineer, license, sell, transfer, or create derivative works from any content.

6. Training, Certifications & Assessments

Completion of training programs, assessments, projects, certifications, internships, or evaluations does not automatically guarantee employment, promotion, compensation, professional licensing, or business success.

Certification eligibility and issuance remain subject to successful completion of applicable requirements.

7. Placement Assistance & Employment Services

JALA Academy may provide placement assistance, career support, interview preparation, employer introductions, and recruitment-related services.

Employment outcomes depend upon individual skills, qualifications, attendance, communication abilities, market conditions, employer requirements, and other factors outside our control.

Unless expressly stated in a separate written agreement, JALA Academy does not guarantee employment, salary levels, job titles, locations, employer selection, or hiring timelines.

8. Internship Programs

Internship opportunities may be offered based on eligibility, performance, project availability, business requirements, and applicable policies.

Internship participation does not create an employment relationship unless expressly stated in writing.

9. Payments & Fees

Users agree to pay all fees, charges, taxes, and applicable amounts associated with services selected.

Payment obligations remain subject to our Refund Policy and any applicable program-specific agreements.

10. Privacy & Data Protection

Collection, processing, storage, transfer, disclosure, and use of personal information shall be governed by our Privacy Policy.

Users acknowledge that personal information may be processed for educational, operational, recruitment, certification, compliance, and service delivery purposes.

11. International Users

Users accessing services from outside India are responsible for complying with applicable local laws and regulations.

Personal information may be transferred internationally subject to applicable safeguards and legal requirements.

12. Third-Party Services

Our services may integrate with third-party websites, applications, payment providers, learning tools, communication systems, cloud providers, and employer platforms.

JALA Academy is not responsible for the content, availability, security, policies, or actions of third parties.

13. Security

Users are responsible for safeguarding account credentials and immediately reporting suspected security incidents.

While we implement commercially reasonable security measures, no system can be guaranteed completely secure.

14. Disclaimer of Warranties

Services are provided on an "AS IS" and "AS AVAILABLE" basis.

To the maximum extent permitted by law, JALA Academy disclaims all warranties, express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, and reliability.

15. Limitation of Liability

To the maximum extent permitted by applicable law, JALA Academy shall not be liable for indirect, incidental, consequential, punitive, exemplary, special, or business losses.

JALA Academy's aggregate liability arising from any claim shall not exceed the amount paid by the user for the specific service giving rise to the claim.

16. Indemnification

You agree to indemnify, defend, and hold harmless JALA Academy, its affiliates, directors, officers, employees, contractors, franchise partners, agents, and licensors from claims, liabilities, damages, losses, costs, and expenses arising from your use of services, violation of these Terms, or violation of applicable laws.

17. Force Majeure

JALA Academy shall not be liable for delays, interruptions, failures, or inability to perform obligations caused by events beyond reasonable control, including natural disasters, pandemics, cyber incidents, government actions, wars, labor disputes, internet outages, and infrastructure failures.

18. Compliance with Laws

These Terms are intended to comply with applicable laws including:

  • Digital Personal Data Protection Act, 2023 (India)
  • Information Technology Act, 2000 (India)
  • Consumer Protection Act, 2019 (India)
  • General Data Protection Regulation (GDPR)
  • UK GDPR
  • California Consumer Privacy Act (CCPA/CPRA)
  • Applicable international privacy, cybersecurity, and consumer protection laws

19. Suspension & Termination

JALA Academy reserves the right to suspend, restrict, or terminate access to services for violations of these Terms, misconduct, security concerns, fraud, non-payment, or unlawful activities.

20. Amendments

We may update these Terms from time to time. Revised Terms become effective upon publication on our website.

21. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India.

Parties shall first attempt to resolve disputes amicably through good-faith negotiations.

If disputes cannot be resolved amicably, they shall be referred to arbitration under the Arbitration and Conciliation Act, 1996.

The seat and venue of arbitration shall be Hyderabad, Telangana, India. Proceedings shall be conducted in English.

22. Exclusive Jurisdiction

Subject to applicable law, all disputes, claims, proceedings, applications, petitions, and legal actions arising out of or relating to JALA Academy, its services, websites, programs, internships, placement services, certifications, policies, and agreements shall be subject to the exclusive jurisdiction of the competent courts located in Hyderabad, Telangana, India.
